Naming your business is an important step and requires a thorough search when you choose your business name. Represents the identity of the company and it’s important for that name to be unique, to be not confoundable with some other company and most definitely not similar with other companies. The business name must be registered with the county clerk’s office and/or the Secretary of State.
If there are two companies with the same name or there are signaled some similarities, and if both of them have properly filed the Assumed Name Certificate, the right of using the name will be decided in court.
So taking enough time to research in this field will help avoiding supplementary legal costs after the opening of the business.
